These terms cover this site and how a booking is made. The written quote that you approve is the agreement for your event, and it takes priority wherever the two differ.

Who we are and when these terms apply

Pizza Pod NYC (“Pizza Pod”, “we”, “us”) runs this site. We are a mobile pizza caterer in New York City.

If you use the site or send a request, you agree to these terms. If you do not agree, do not use the site.

To book an event, you must be 18 or older. If you book for a company, you confirm that you can agree to these terms for it.

What this site is

A description of the service and a way to ask for a quote. Prices, capacities and lead times shown here are estimates. Nothing on this site is a binding offer, and a request does not hold a date.

Quotes and bookings

We read your request, ask about anything unclear, and send a written quote with a fixed price and what it includes. The date is held once you approve that quote and pay any deposit it asks for.

Until then the date stays open to anyone else who asks for it.

Payment

Your written quote sets out the price, any deposit, when the balance is due and how you can pay. If your company pays by invoice or needs a purchase order, say so when you ask for the quote. We will confirm it before you approve.

Cancellation, weather and rescheduling

Some events are outdoors, so weather is part of the plan rather than a surprise. Your written quote sets out the cancellation window, what is refundable, what happens in rain or severe weather, and how to move a booked date. If any of that is missing from your quote, ask us before you approve it.

What you provide

The Pod is small, but it needs a few things to work. Unless your quote says otherwise, you are responsible for:

  • A legal, reserved parking space, or an equivalent flat area we can occupy for the length of the event
  • A level surface the Pod can sit on
  • Power, where the setup calls for it: we confirm what is needed when we check your space
  • Venue permission, and any building or street access we need to get in and set up

If the space is not there on the day

Sometimes we arrive and the space, access or surface is not what was agreed. If we cannot set up, we will do whatever we can on the spot. Where nothing workable is available, it is treated as a cancellation on the day, under the cancellation terms in your quote.

Food, allergens and dietary needs

Everything is made to order in one small mobile kitchen, on shared surfaces, with wheat flour and dairy always present. We can work around dietary needs when you tell us in advance, but we cannot promise that any food is free of allergens.

You are responsible for telling us about the allergies and dietary needs of your guests. A guest with a serious allergy can ask our cook about any pizza at the event.

Permits and insurance

Ask us about permits and insurance before you approve your quote. That includes whether your venue needs a certificate of insurance, and how long it takes to issue one. Where an event needs a street closure or a building permit, the organizer holds it unless the quote says we do.

Photography

We photograph the Pod, the oven and the food at events, for this site and our social media. Guests can appear in the background.

If you do not want photos taken at your event, tell us before the event and we will not take any. If you appear in one of our photos and want it removed, email us and we will remove it.

Rent a Pod equipment rentals

A Rent a Pod booking is governed by two documents you sign before any equipment is handed over: the Rental and Safety Agreement and the Liability Waiver and Assumption of Risk. Where they and this page differ, they win.

In short: the renter is responsible for the safe operation and supervision of the equipment, must follow the instructions provided, and is responsible for damage, loss or theft during the rental period. Gas ovens are for outdoor use only. Full payment and a credit card authorisation as security are required before pickup or delivery, and equipment is to be returned clean, complete and operational. Cleaning, late-return, repair and replacement charges may apply.

Prices and package contents shown on the Rent a Pod page are indicative and can change; the invoice you approve is the price for your rental. The estimate the package builder shows is arithmetic on those published prices and is not a quote.

Using this site

You can use this site to learn about Pizza Pod, to send requests and to share links to its pages. Do not:

  • Send false information, or a request in another person's name
  • Send spam, advertising or harmful code through the forms
  • Try to get into, overload or disrupt the site
  • Copy or scrape the site's content, other than a short quote with a link back

Our content and trademarks

The text, photos, video and design of this site belong to Pizza Pod or to the owners named on the Credits page. You cannot copy or reuse them without written permission, except where the law allows it.

The Pizza Pod name and logo are our trademarks. The other names and logos on this site belong to their owners.

Other websites

The site links to other websites and shows content from YouTube, Instagram and Google Maps. Those companies control their content, and their own terms apply to it. We are not responsible for it.

Liability

We provide the site free of charge and as it is. We try to keep it accurate, but we do not promise that it is complete, current or free of errors.

To the extent the law allows, these limits apply. We are not liable for loss that comes from using the site, or for indirect loss, such as lost profits. For an event, our total liability is limited to what you paid us for that event.

Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud. The same applies to any other liability that the law does not let us limit. If you are a consumer, you keep all the rights that consumer law where you live gives you.

Changes to these terms

We can change these terms. The date at the top shows the last change. The version that applies to your event is the one in force when you approved your quote.

Governing law and disputes

New York State law governs these terms and any booking made under them. If there is a problem, email us first, so that we can try to fix it.

If a dispute goes to court, the state or federal courts in New York County, New York, decide it. If you are a consumer who lives somewhere else, you can also go to the courts where you live.

If a court finds that part of these terms cannot be enforced, the rest still applies. If we do not enforce a term at once, we can still enforce it later.
